These Terms and Conditions of Use (the “Terms of Use”) apply to (“Sayulita Fireworks” “we,” “us,” or “our”) website located at https://www.akumalfireworks.com, and all associated sites linked to https://www.akumalfireworks.com by Mac Event Inc., its subsidiaries and affiliates, including Mac Event Inc. sites around the world (collectively, the “Site”). The Site is the property of Mac Event Inc. (“Mac Event”) and its licensors. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

Acceptance of the Terms

By viewing, navigating, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms as well as all applicable laws. Additionally, you represent and warrant that you possess the legal authority and capacity to accept these Terms either for yourself or on behalf of the entity you represent.

Modifications to Terms

Mac Event retains the right, at its sole discretion, to modify, amend, or remove any part of these Terms of Use at any time. It is your responsibility to review these Terms of Use periodically for updates. Your continued use of the Site after any changes are posted indicates your acceptance of those changes. Provided you comply with these Terms of Use, Mac Event grants you a personal, non-exclusive, non-transferable, and limited license to access and use the Site.

Content

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, the “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel,” and arrangement of such Content displayed on the Site, is owned, controlled, or licensed by or to Mac Event. The Content is protected by trade dress, copyright, patent, and trademark laws, as well as various other intellectual property and unfair competition laws.

Unless expressly permitted under these Terms of Use, no portion of the Site or its Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any manner (including “mirroring”) to any other computer, server, website, or other medium for publication or distribution, or for any commercial enterprise, without Mac Event’s explicit prior written consent.

Prohibited Uses and Access Restrictions

You may not use any “deep-link,” “page-scrape,” “robot,” “spider,” or other automatic device, program, algorithm, or methodology, nor employ any manual process with similar functionality, to access, acquire, copy, or monitor any portion of the Site or its Content. You are also prohibited from reproducing or circumventing the Site’s navigational structure or presentation to obtain or attempt to obtain any materials, documents, or information not deliberately made available through the Site. Mac Event reserves the right to block any such activities.

You may not attempt to gain unauthorized access to any portion or feature of the Site, nor to any other systems or networks connected to the Site or to any Mac Event server, nor to any of the services offered on or through the Site, whether by hacking, password “mining,” or other illegitimate means.

You may not probe, scan, or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures in place on the Site or any network connected to it. Furthermore, you may not reverse look-up, trace, or seek to trace any information regarding any other user or visitor to the Site, including any Mac Event account not owned by you, in an effort to discover personal data or other information that is not your own.

You agree not to take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or on Mac Event’s systems and networks, or on any systems and networks connected to the Site or Mac Event. You also agree not to use any device, software, or routine to interfere with or attempt to interfere with the proper functioning of the Site or any transaction taking place on the Site, or with any other person’s use of the Site.

You may not forge headers or otherwise manipulate identifiers to conceal the origin of any message or transmission you send to Mac Event through the Site. You may not pretend to be someone else or to represent another entity, nor may you impersonate any other person or entity while using the Site or any service provided on or through the Site.

You may not use the Site or its Content for any unlawful purpose or for any purpose prohibited by these Terms of Use. Additionally, you may not use the Site or its Content to solicit the performance of any illegal activity or other activity that infringes upon the rights of Mac Event or any other party.

Services

Through our Services, we provide information and promotional content about products and services relevant to the party, event, and wedding industries, as well as other significant life events. We collect inquiries submitted by “Users” through our Site and forward them to companies and third parties that offer products and services related to weddings or other important life events (collectively referred to as “Vendors”). In essence, Mac Event operates solely as a marketing agency, facilitating connections between Users and Vendors. Our Services are exclusively available to individuals who are at least 18 years old and capable of entering into legally binding contracts under applicable law, as well as to legally recognized business entities.

Users

As a Member, you acknowledge that while we employ methods to verify the identity of Vendors when they register for memberships or subscriptions on our Services, we cannot and do not guarantee the identity, qualifications, capabilities, or compliance of any Vendor with applicable laws, permits, licenses, or consents. Additionally, we do not endorse any specific Vendor or guarantee the quality of their goods or services. Our Services are intended to serve as a starting point for identifying Vendors that offer the products and services you need. It is your responsibility to conduct your own research and due diligence to ensure that the Vendors you choose to engage with meet your standards and requirements.

User Acknowledgment and Limitation of Liability

As a User, you acknowledge that Mac Event is not a product or service provider, Vendor, or an agent or representative for any Vendor. Our Services operate solely as a neutral platform and digital clearinghouse that facilitates connections between Users and Vendors for specific services or products. We are not involved in or a party to any transaction between Users and Vendors.

As such, we have no control over the existence, quality, accuracy, safety, or legality of transactions conducted through our Services, nor the accuracy of any Vendor listings. We do not oversee the ability of Vendors to deliver goods or perform services, nor do we have any influence over the ability of Users to pay for goods and services.

We make no representations or warranties regarding these transactions and are not liable or responsible for the actions, inactions, or performance of any User or Vendor.

In no event shall Mac Event, its directors, employees, or agents be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of or inability to use the Services.

To the fullest extent permitted by law, Mac Event’s total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us for the particular Services giving rise to the claim.

You agree to indemnify, defend, and hold harmless Mac Event, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

Governing Law

These Terms, and any disputes directly or indirectly arising from or related to these Terms or the Services, shall be governed by and construed in accordance with the laws of the state or jurisdiction where Mac Event maintains its principal place of business, without regard to conflict-of-law principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in that jurisdiction.

Termination

We reserve the right to suspend or terminate your access to the Services for any or no reason, including a violation of these Terms, without prior notice. Upon termination, all rights granted to you under these Terms will cease, and you must immediately cease all use of the Services. Sections relating to limitation of liability, indemnification, intellectual property, and governing law shall survive any termination.

BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS OF USE AND AGREE TO BE BOUND BY THEM.
